This interactive workshop, delivered in partnership with Clarkslegal LLP and RJC Consultants, will provide a practical introduction to the adjudication process, the most commonly used form of dispute resolution in the construction industry. You will learn how to maximise prospects for successful pursuit and defence of contractual claims.
The workshop will stage a mock adjudication that re-enacts typical procedures and addresses typical issues that arise, to ensure you understand the entire process of adjudication and its application, and how to maximise the opportunities and minimise the threats inherent in the process.
The workshop will have equal relevance to public and private sector clients/end users, main and specialist build contractors and consultants.

Who should attend?
Those responsible for overseeing or ensuring performance and delivery of building contracts/consultancy services to include Managing Directors, Legal Directors, Finance Directors, Project Managers.
AimsThe workshop focuses on the adjudication process and its preparation, to ensure clients are fully briefed and equipped to achieve their desired outcome.
In particular, the following topics will be covered in detail:
- What steps to take before starting adjudication?
- To what extent must a contract be in writing?
- Can an adjudicator decide on his own jurisdiction?
- An adjudicators conduct multiple adjudications on connected or related matters?
- To what extent can a party rely on 'new' facts and matters?
- What errors invalidate the decision of an adjudicator?
- Can delay by adjudicators withhold delivery of their decision until their fees have been paid?
- Is there a right to set-off against adjudicator's decision?

Active paticipationIn addition to presentations from experienced specialists, the mock adjudication will provide an accurate and up to date representation of adjudication. This demonstration will ensure delegates understand what would be expected from them and other stakeholders in the process.
Regular breaks and intervals, in addition to networking, will provide the opportunity for delegates to interact with the speakers and debate recent examples of cases and create a practical and hands on learning experience.
The speakers/presentersDavid Rintoul - Partner, Clarkslegal LLP - David is Deputy Managing Partner and Head of Construction at Clarkslegal LLP and recommended in legal directories as a leading construction lawyer in the Thames Valley and South East regions.
Stephen James - Associate, Clarkslegal LLP - In all his practice areas Stephen has gained substantial court experience and often conducts his own advocacy. He is also familiar with the particular rigours associated with injunction hearings and has participated in many mediations and other forms of alternative dispute resolution.
Martin Salt - Senior Solicitor, Clarkslegal LLP - Within Clarkslegal's construction team, Martin works for employers, contractors and specialist trade contractors, undertaking both contentious and non-contentious work. He is also a member of the Society of Construction Law and the Adjudication Society.
Ray Crabbe - Managing Director, RJC Consultants - Ray established RJC Consultants in 1993 as a vehicle for him carrying out Expert Witness work and claims mainly for contractors. Ray specialises in adjudication, expert witness, contractual advice and managing arbitration for clients and is a CEDR trained mediator and a CIOB trained Adjudicator.
Roger Smith - Director, RJC Consultants - Roger manages the Thames Valley Office of RJC, he trained as a quantity surveyor but has extensive experience in commercial management, procurement, contract administration, conflict avoidance and dispute resolution.
